Terms and conditions of use
The Site is published by A DE FUSSIGNY S.A.S., a company incorporated under French law with its registered office in Cognac – 16100 – France, registered in the Angoulême Trade and Companies Register under number 501 302 129 (hereinafter “ADF”).
The use of the Site by any person (“the User”) is governed by these general terms of use (the “General Terms of Use”). The purpose of the General Conditions of Use is to define the conditions of access to and use of the Site.
By accessing the Site, you accept without reservation the application of the General Terms of Use and the applicable clauses on the protection of personal data (see the Privacy Policy).
ADF may at any time update the General Terms of Use and the Privacy Policy. The user is invited to consult them regularly.
To access the Site, you must be of legal drinking and/or purchasing age according to the legislation in force in your country of residence (whichever is higher).
If there is no legal age in your country of residence, you must be at least 21 years old to access the Site.
1. NAVIGATION ON THE WEBSITE
1.1 Access to the website
Hardware and software required to access the Site are the responsibility of the User.
ADF reserves the right, in its sole discretion, to terminate access to all or any part of the Site or its contents without liability for any compensation to User.
It is, of course, strictly forbidden to modify any software element of the Site whatsoever for the purpose of obtaining unauthorized access to the Site.
1.2 User behavior
The User of the Site warrants:
– to be of legal age to consume and/or purchase alcohol according to the legislation in force in his/her country of residence;
– use the Site for lawful and personal purposes;
– that, where applicable, the data he or she provides is accurate and truthful.
User is strictly prohibited from making any representations and/or acting in the name of and/or on behalf of ADF, its subsidiaries and affiliates, for any purpose whatsoever.
Users shall conduct themselves on the Site in a responsible, lawful, and respectful manner towards other users of the Site, ADF, its affiliates, and third parties.
In particular, the User is prohibited from:
– upload to the Site, post, email or otherwise transmit any material containing software viruses, or computer programs designed to interrupt, destroy or limit the functionality of any software or telecommunications equipment;
– disrupt or interrupt the operation of the Site;
– impair the operation of the Site, including exposing the Site to a virus, causing a bandwidth overload;
– view information that is not intended for it;
– engage in illegal activity or any other activity that may be detrimental to the rights of ADF, its suppliers, providers, retailers, advertisers or others;
– upload to the Site, post, email or transmit any unlawful, harmful, libelous, defamatory, offensive, racist, vulgar, obscene, threatening, violent, indecent, invasive of another’s privacy, derogatory or racially, ethnically or otherwise objectionable content;
– email or otherwise transmit any content from the Site to persons under the legal drinking age in their country of residence.
If necessary, ADF is entitled to terminate at any time the right of access to the Site of the User who does not comply with the obligations arising from the General Terms of Use and/or any other supplementary document, without prejudice to the right of ADF to claim damages.
1.3 User-published content
Where applicable, users of the Site are solely responsible for the content they post on the Site and the consequences of its dissemination, publication, transfer or provision. ADF disclaims all liability for content posted on the Site, within the limits of applicable regulations.
However, ADF reserves the right to decide whether content posted by users meets the requirements specified in the Terms of Service and may remove any content that violates these Terms of Service.
The User agrees that ADF may freely use, without any restriction or time limitation and free of charge, the content posted on the Site not only for its dissemination on the Site but also for its dissemination and reproduction on any other medium whatsoever for the promotion and advertising of ADF, its products and/or its services.
2. PROTECTION OF THE CONTENT OF THE SITE
The Site and each of the elements that make it up (in particular the texts, photographs, illustrations, images, diagrams, texts, logos, trademarks, drawings and models), including the software elements necessary for the operation of the Site (the “Content”) may contain confidential information and data protected by the Intellectual Property law or any other applicable law. The Intellectual Property rights on the Content are the exclusive property of ADF, which does not grant the User any license or any other right than the right to consult the Site
3. PERSONAL DATA
ADF takes care to protect the personal data transmitted, if any, by the User of the Site. The Privacy Policy specifies the provisions put in place to guarantee the processing of data. The collection, processing, use, transmission, storage and protection of the User’s personal data are governed by the Privacy Policy.
4. RESPONSABILITY
ADF makes every effort to ensure that the information it publishes on the Site is accurate and up-to-date. However, ADF cannot guarantee the accuracy, precision or completeness of the information made available to Users on the Site.
ADF allows access to the Site free of charge and declines all responsibility for any interruption of the Site, in the event of the occurrence of computer viruses, display or download errors, for any inaccuracy relating to the Content of the Site, for any damage resulting from fraudulent intrusion by a third party and more generally for all direct and indirect damage, whatever the causes or consequences, which may occur following access to the Site and resulting from any information from the Site.
5. APPLICABLE LAW AND JURISDICTION
The Terms of Use, as well as the Privacy Policy, are governed by French law.
Any dispute concerning the Content and the use of the Site shall fall under the exclusive jurisdiction of the competent court within the jurisdiction of the Commercial Court of Angoulême, including in the event of an appeal in warranty, multiple defendants, summary proceedings or on petition.
6. COOKIES AND SITE NAVIGATION
The LWS web server automatically collects standard information such as the user’s IP address, browser type, operating system, access times, etc.
The www.summumvodka.com website does not use cookies to personalize web page content. Cookies are small electronic files that a website can transfer to a user’s hard drive to identify the user and personalize their use of that website. Any information collected indirectly will only be used by ADF to track the volume, type and pattern of traffic using this site, to develop the design and layout of the website and for other administrative and planning purposes.
Privacy Policy
By providing us with your personal information and data, you consent to its use and disclosure as defined below:
1. GENERAL INFORMATION
Through the Site, ADF may collect personal data communicated in particular in the context of requests for information (e.g., last name, first name, e-mail address, age, city, state and country of residence, telephone number).
Any personal information that you may be required to transmit to ADF for the use of certain services is subject to the provisions of the French law n° 78-17 Informatique et Libertés of January 6, 1978.
2. RIGHT OF ACCESS, RECTIFICATION, DELETION AND OPPOSITION
The User has at any time the right to access, rectify, and delete personal information concerning him or her, and the possibility of objecting to the processing of such data. 3. PERSONAL DATA MANAGEMENT

Through the Site, ADF collects data about you solely for the following purposes:
customer and prospect relationship management, commercial segmentation, personalization of our services and communications, transmission of information relating to ADF and its statistical activity, studies and analyses, marketing, improvement of the Site, ADF products and services,

b. Data retention
The data is kept for as long as necessary for the purposes for which it was collected and is, in any case, destroyed at the end of it.
c. Recipients of the data
Except for the cases mentioned above, ADF will only transmit your personal data to a third party when
the sharing of such information with such third party is strictly necessary for the provision of the products or services and/or when ADF is required by a judicial or other competent administrative authority to disclose such information.
d. Data security and privacy
ADF endeavors to implement all useful precautions to preserve the confidentiality and security of personal data collected and processed and prevent them from being distorted, damaged, destroyed or accessed by unauthorized third parties.
However, ADF does not control all the risks associated with the operation of the Internet and draws the attention of the users of the Site to the existence of possible risks inherent to its use and operation.
4. CHANGES TO OUR PRIVACY POLICY
ADF may change this Policy from time to time. We will ensure that you are informed of such changes either by a special notice on our Site or by a personalized warning, particularly in our newsletter mailings.
5. PROTECTION OF UNDERAGE DRINKERS
As access to the Site is governed by the Site’s Terms and Conditions of Use, ADF shall not collect any information or personal data relating to persons under the legal drinking and/or purchasing age according to the legislation in force in their country of residence.
